Hospitalized for Tests After Court Ruling Nullifying Conviction
NEW YORK — Harvey Weinstein, the former movie mogul
whose 2020 rape conviction was recently nullified by an appeals court, has been
hospitalized in New York City for a battery of tests, according to his lawyer
on Saturday.
Attorney Arthur
Aidala stated that Weinstein was admitted to Bellevue Hospital in Manhattan
after his return to the city from jail on Friday. Aidala described Weinstein's
condition as requiring significant medical attention, citing a range of health
issues.
“They examined him
and sent him to Bellevue. It seems like he needs a lot of help, physically.
He’s got a lot of problems. He’s getting all kinds of tests. He’s somewhat of a
train wreck health-wise,” Aidala commented.
The hospital has
not yet responded to requests for comment.
Weinstein had been
incarcerated at the Mohawk Correctional Facility, approximately 100 miles
northwest of Albany, until the New York Court of Appeals overturned his
conviction on Thursday. The court ruled that the trial judge had allowed the
jury to consider evidence not directly related to the charges, leading to the
nullification of his 23-year prison sentence and a retrial order.
Frank Dwyer, a
spokesperson for the New York City Department of Correction, confirmed that
Weinstein remains in custody at Bellevue Hospital. Thomas Mailey, representing
the state Department of Corrections and Community Supervision, stated that
Weinstein was transferred to the city's Department of Correction following the
appeals ruling.
Prosecutors have
expressed their intention to retry Weinstein on charges of forcibly performing
oral sex on a production assistant in 2006 and raping an aspiring actor in
2013.
Weinstein, who was
also convicted of rape in Los Angeles in 2022 and sentenced to 16 years in
prison, has been plagued by various health problems including cardiac issues,
diabetes, sleep apnea, and eye ailments.
According to
Aidala, Weinstein's physical condition prompted his swift transfer to Bellevue
Hospital. Aidala also emphasized Weinstein's mental acuity, describing him as
mentally sharp.
Aidala alleged
that Weinstein was mistreated during his transfer, stating that he was denied
water, food, and bathroom breaks. However, Mailey declined to comment on Aidala's
claims.
Weinstein's lawyer
plans to advocate for a retrial after Labor Day, a sentiment he intends to
convey during Weinstein's court appearance in Manhattan scheduled for
Wednesday.
