10-year-old Texas boy confesses to killing a man 2 years ago; unable to be charged due to age, prompting questions about juvenile justice
A startling revelation has emerged from the Nixon-Smiley Consolidated
Independent School District in South Texas, where a 10-year-old boy confessed
to investigators that he had killed a man two years ago.
According to law enforcement officials, the child made the admission
while being questioned for allegedly threatening to kill a classmate last week.
The incident, which occurred on January 18, 2022, involved the shooting
death of 32-year-old Brandon O'Quinn Rasberry in Nixon, Texas, approximately
one hour east of San Antonio. The child disclosed to investigators that he had
taken a pistol from his grandfather's truck and entered Rasberry's RV at an RV
park, where he shot Rasberry once, resulting in his death.
Surprisingly, the child claimed to have no prior acquaintance with
Rasberry and offered no motive for the senseless act of violence. Investigators
found the murder weapon at a pawn shop in a nearby town, linking it to the
shell casings recovered from the crime scene. However, due to the child's age
at the time of the offense—under 10 years old—he cannot be charged under Texas
law.
The news of the child's involvement in the homicide has left the
community in shock and disbelief. Jonathan Fojtik, the victim's brother,
expressed his dismay, describing the murder as "senseless" and
emphasizing Rasberry's compassionate nature. Fojtik recounted his brother as a
loving individual who was always willing to help others.
While the child cannot be prosecuted for the 2022 homicide, he has been
charged in connection with the recent threat made against a classmate and is
currently in juvenile detention awaiting legal proceedings. The case highlights
the complex legal and ethical questions surrounding crimes committed by minors
