Enoch Burke, a teacher who has been embroiled in a legal dispute with Wilson's Hospital School in Co. Westmeath, has been ordered to appear before the High Court for allegedly failing to stay away from the school, as required by a previous court order.
The school's board of management
has sought further legal action against Mr. Burke, which could lead to his
third imprisonment due to his alleged refusal to comply with the High Court's
orders.
Mr. Burke has reportedly attended the school's
campus every day since August 22, despite being ordered to stay away. The
school claims his presence is disruptive to both staff and students. Mr.
Justice Barry O'Donnell, during a recent court session, expressed that Mr.
Burke "clearly has a case to answer" regarding his alleged breach of
the injunction. Consequently, the judge ordered that Mr. Burke be brought
before the court by Gardaí to answer these allegations.
Mr. Burke was not present at the hearing, but his
mother and sister were in the courtroom and were removed after attempting to
interrupt the proceedings. The judge emphasized that the court would not
tolerate any such disruptions and indicated a preference for Mr. Burke to
voluntarily attend court rather than be arrested.
The school's legal counsel, Rosemary Mallon BL,
expressed the board's reluctance to seek Mr. Burke's imprisonment again but
stated that the school felt it had no other option due to Mr. Burke's ongoing
non-compliance. Despite being previously jailed and fined, Mr. Burke has
continued to attend the school, leading to the current legal actions.
The dispute originated in 2022 when Mr. Burke
allegedly refused to comply with the school's directive to refer to a student
by a different name and pronoun. Mr. Burke has consistently argued that his
legal troubles are a result of his religious beliefs and opposition to
"transgenderism," claims that he denies any wrongdoing.
The ongoing legal battle has seen Mr. Burke
imprisoned twice before, spending over 400 days in Mountjoy Prison across two
stints. The situation remains unresolved, with the court's next steps pending
Mr. Burke's appearance.
